HC wants to know how Anand Teltumbde, Mahesh Raut have same BP, pulse and O2 levels, weight, height in jail reports

HC seeks explanation after Taloja jail’s medical reports say they are also identical in height, weight.

The Bombay High Court has sought an explanation from Taloja Prison officials following revelations that certain portions of academic Anand Teltumbde and activist Mahesh Raut’s medical reports, both accused in the Bhima Koregaon-Elgar Parishad case, are exactly the same. The two approached the HC after co-accused Telugu poet Varavara Rao tested positive for the coronavirus last month.

Two separate medical reports, submitted through the superintendent of Taloja Prison and attested by the chief medical officer, show the same statistics for both Teltumbde and Raut, including blood pressure, pulse, oxygen levels, weight and height. However, the first report states that Teltumbde has developed antibodies for the coronavirus, which means he was infected by the virus at one point, while Raut’s report says he has tested negative. Raut, the youngest accused in the case, was allegedly suffering from fever for four consecutive days.

Oxygen levels, pulse rate and blood pressure are important indicators of a person’s health and are attached to medical reports to show s/he is fit, especially when seeking bail on medical grounds.

Based on an earlier order of the court, the prison officials were directed to provide test reports to the families. During the hearing, Raut, represented by advocate Vijay Hiremath, said he was not sure if this was his client’s report. “You should be happy, your client has tested negative,” Justice RG Dhanuka said.

“But I am disputing this report,” Hiremath said, adding: “It can’t be that both the accused have the same pulse, BMI, weight, height and oxygen; even the blood pressure is the same. Even otherwise, an antigen test will not show if he suffers from corona, an antigen test will only show if he has had corona in the past.”

Appearing on behalf of Teltumbde, advocate Devyani Kulkarni said there are some “alarming factors and questions raised” if the report belongs to Teltumbde.

“According to this report his height is 153 cm and weight is 57 kg. However, his height is actually 173 cm and weight is around 75 kg.” She added that based on the similarities in these two reports, they would also want a copy of activist-writer Vernon Gonsalves’ report. “On the last date we were only informed he had tested negative but not provided a report.”

While initially questioning the prosecutor regarding the similarities, the division bench of justices RG Dhanuka and Bisht then directed the prosecutor to take proper instructions from prison officials and explain the discrepancies.
