MUMBAI: The Dahanu sessions court on Monday granted bail to 28 tribals, accused in the Palghar lynching case in which two seers and their driver were killed, after the police failed to file the chargesheet within the stipulated 90 days of first remand of the accused.
Of the 28, only 10 accused will walk out of prison because the remaining 18 were named in the third chargesheet filed on August 3.
These 18 were not named in the first two chargesheets filed on July 15.
Judicial magistrate M V Jawale granted bail under Section 167 (2) of CrPC on a personal surety bond of Rs 30,000 each, said advocate for the accused, Amrit Adhikari. This is the first set of accused who have been granted bail.
The 28 accused were taken into police custody on April 18 and April 30. Eighteen of the 28 accused were among the 47 named in the third chargesheet. In the earlier two chargesheets (126 accused), filed on July 15, their names did not figure. They were booked for offences of attempt to murder, deterring public servant from discharge of his duties, voluntarily causing hurt to a public servant in the discharge of his duty and rioting with deadly weapon, among other charges.
The 10 accused were granted bail after Adhikari argued that the police had not found any evidence against them and the chargesheet against them was yet to be submitted. He told the court that it is a clear case of illegal detention and they have been lodged in the prisons in Thane, Palghar, Boisar and Taloja.
Public prosecutor R B Walvi opposed bail, saying CID was in the process of gathering evidence against all arrested accused. On July 14, the court had rejected bail plea of 25 accused booked for murder.
The case pertains to the lynching of seers Chikne Maharaj Kalpvirkshagiri (70) and Sushilgiri Maharaj (35) and their driver Nilesh Telgade (30). The CID has ruled out any religious angle and said the lynching was a fallout of rumours of a child- lifting gang operating in the area.
